Judge used Thomas logic to determine that Smith's appointment was not legal
I will have to wait to see what sort of appeal that Smith will mount, but it seems odd that the entire case is tossed because Smith's appointment was unconstitutional. One might think he should be allowed to turn over the case to someone who is an actual Federal prosecutor, but maybe that is not how this works. Perhaps the entire indictment is null and void because he is the one who brought it.
People on the left are, of course, beside themselves right now. But as they say, if you live by the sword you die by the sword, or in this case if you live by lawfare, then you can also die by lawfare, something that appears to be happening to Jack Smith. Perhaps had they just run a campaign about Joe Biden rather than try to push Trump off the ballot, put him in jail, and then murder him, we wouldn't be in this predicament.
One will have to wait to see how this now affects the Jan 6th DC case which is overseen by a different judge. Now that we have a split at the lower court level on the legality of the Smith appointment, that would seem to be a matter that will need to be resolved by a higher court, and one would have to believe it will be the USSC that ultimately makes the call. Smith's chances of seeing a trial (even between election and inauguration if Trump wins) would seem to have been diminished although you never know.
