The falsified business record only holds up if Bragg can prove it was used to hide another crime.
The other crime is another dead misdemeanor statute that criminalizing any conspiracy to promote or prevent an election by "unlawful means" which means Bragg must show that Trump conspired to win his own election by unlawful means.
Which if you are following, the unlawful Bragg is suggesting would have been the non-disclosure agreements and other hush money payments, even though none of this is illegal.
Bragg wishes to suggest that they were illegal, because they were not reported as a campaign contribution (which is now the third layer of statute that Bragg has brought forward). But even that alleged crime would be the non-reporting of the payments, not the payments themselves and the action of reporting it would not have any effect on the election.
However, Bragg is a county prosecutor with no authority and no expertise to make such a charge or by nature even a suggestion, especially considering the FDA has already ruled on the subject and has clearly stated that NDA and like payments are not contributions and do not need to be reported. He is attempting to suggest a federal crime to assist in his state crime, which is needed to prove the underlying crime of falsifying business records.
At the end of the day, this means that Bragg is using two different (time barred) misdemeanors and a time barred Federal civil violation that has already been determined not to be a violation, in order to charge the former President with 34 felony counts? Moreover, he found a judge willing to go along with this nonsense. You really cannot make this shit up.
