The Smith appointment was always political and designed to simply hurt Trump

Special Counsel Jack Smith "can still hurt" former President Donald Trump in his election interference case despite setbacks, according to a legal expert.

In a blog post on the CAFE.com website, senior CNN legal analyst Elie Honig wrote that following the Supreme Court's July ruling that former presidents have substantial immunity from prosecution for "official acts," crucial parts of Smith's case against Trump for alleged election interference could be excluded from being used in court, including the former president's alleged "pressure campaign" aimed at Mike Pence and his "effort to coerce the Justice Department."


The idea of course, would be to simply hold a hearing to discuss the evidence that is in question and whether or not it would fall under Presidential immunity per the USSC ruling. However, even a numskull who gets his legal expertise from watching Perry Mason would understand that holding any sort of a "public" hearing on said evidence with be akin to soiling the jury pool. 100 times out of 100 times, if there was a hearing that would bring up potential evidence that a Jury would never hear, then that hearing would be done in private to protect that defense from having inadmissible evidence tossed out into the public arena for everyone to discuss. The only reason to hold it public would be to embarrass Trump (which has been what Smith and Chutkan have done so far).


This is really one of those times when our media and punditry has almost openly admitted (at least in action and deed) that these trials were designed to politically harm Trump more than legally harm him. Very few people expect that charges would hold up under appeal or that Jack Smith would not be fired as soon as the election is over. Even if Trump were to lose the election, the idea that Harris as the new President would allow Smith to continue would do more damage tearing apart the country than one could imagine.
