That brings us to Michigan, where the House just adopted HB 4474. The proposed law and an adopted amendment would criminalize, for instance, speech causing “severe mental anguish” to another person. That standard is absurdly subjective and vague. Although the proposed law would use the “reasonable person” standard, it still leaves a rogue prosecutor with the ability to criminalize words because someone’s feelings were hurt “really bad.”

One local attorney correctly noted that HB4474 is impossibly vague and open to subjective standards:

Under the proposed statute, “intimidate and harass” can mean whatever the victim, or the authorities, want them to mean. The focus is on how the victim feels rather than on a clearly defined criminal act. This is a ridiculously vague and subjective standard.

Make no mistake. If this law stands, it is only a matter of time before someone is literally charged with a crime for misgendering someone, or using the wrong pronoun, or otherwise failing to follow the woke virtue signaling that some of these crazies expect out of society. If you have no real good logical argument for why it is important to call a person "they" or whatever, then people will not do it. Threatening to cancel them or demanding things in a classroom setting only works in some situations. To really force people to do your personal political bidding, you would need a law. Something that can coerce what you cannot convince people of.

Now there is literally no good reason why being called the wrong (but obvious) pronoun is considered intimidating or harassing. Moreover, when you look to blur the lines in this fashion it makes it ripe for prosecutorial misconduct. What happens is the wrong prosecutor in the wrong part of the state charges some woke Gen-Z idiot with causing harm to a Christian under the same statute? Will the left have a meltdown then?
