Smith documents case on hold...

Judge Cannon is delaying the case after Smith and his team admitted to tampering with evidence.

Judge Aileen Cannon indefinitely postponed Special Counsel Jack Smith's classified docs prosecution of Donald Trump Tuesday because the DOJ failed to correctly preserve key evidence. The ruling is a big blow to Smith and the DOJ and throws the future of their case into doubt. 


Jack Smith is used to getting his way. He will be given every benefit of the doubt and then some on the loopy case in D.C. where they will pretend that Donald Trump defrauded the United States by claiming that the election was not on the up and up. But in the more serious case (the one that most analysts believe is the most serious) he is not getting his way. In fact, one might say that Cannon is the opposite of the other Trump judges, in that she actually does rule occasionally against the prosecution. Go figure.


Now that we have seen that the Smith team has not kept their noses clean on the documents, perhaps Cannon was ultimately proven correct in her earlier ruling to call in a special master to oversee the document transfers. If you recall, that ruling was overturned on the basis that she did not have "authority" to require it, even as the appeals court suggested that the special master was not inappropriate. Right now, the idea that we could blindly trust the prosecution with this documentation (rather than have anyone supervise them) has turned out badly. Particularly badly for Smith if he doesn't get this case up and running before the election.

No legal expert here but I'd like to see Smith charged with something in the line of "malicious prosecution" in Florida. Seeing him in jail would be true justice.
