Minnesota sues DHS to stop ICE from arresting illegal criminals.

Arguing states rights under the 10th amendment?

Ahem. I am not sure that there is a District Judge (even a liberal rubber stamper) who can take this seriously. But even if there was, Minnesota is in the Eighth Circuit Appellate court where there is a grand whopping total of one Judge who was nominated by a Democrats. There is no chance this goes anywhere.


Now while the legal reasoning is apparently the 10th amendment, the rambling of the lawsuit forms the narrative that Trump is using ICE to pick on Minnesota because of their liberal politicians. From what I have read and heard, the entire lawsuit is based on rhetoric and claims that Ellison cannot actually prove. You know, that Trump is using the Somalian fraud as an excuse to target a liberal area and harass law abiding citizens. I doubt he has any hard core evidence that this is just about hating on Walz and other Democrats in Minnesota or even a single bit of evidence that ICE is simply harassing law abiding citizens.


At the end of the day, Federal law is supreme and Minnesota is part of this Federation. Federal law enforcement has jurisdiction everywhere, and states electing politicians who are of the opposite party of the President don't just get to opt out of Federal law whenever they feel compelled. The courts have ruled over and over that sanctuary cities and such have no authority to obstruct DHS or ICE and certainly no authority to keep them out. There is not a single legal principle here that falls on the side of Minnesota here.


So why do it? Distraction? To rile up Minnesotans even more? To look like they are doing something? I think the real answer is that by filing a lawsuit, at least for a while it provides the silliest of these people that their beliefs have some semblance of merit and that ICE really is breaking the law by enforcing it. When the suit is dismissed, then they can claim it was a right wing judge who ruled against them. In fact, they may even hope for a hard core conservative judge to make the ruling.
