Minnesota loses lawsuit to block ICE from enforcing the law in Minnesota.

Ruling comes from same judge who was just overruled by the Eight Circuit Court on her ruling that limited ICE behavior.

So shortly after the Eight Circuit Court determined that a judge could not determine how ICE did its job, Ellison files another suit with the same judge demanding that ICE leaves Minnesota all-together. Ellison, of course, is supposed to be Minnesotan's leader in law enforcement and legal arguments. Not sure that a random person off the streets wouldn't be a better choice for that job.


Either way, I suppose they were hoping for some form of short-term legal victory that everyone knew would be overturned a few days later. Perhaps they believed that this judge would humiliate themselves one more time for the good of the cause, but not to be. The judge, fresh off a serious rebuke for her previous 32-page ruling, decided to follow the law this time around and (go figure) determined that Minnesota did not have a right under the 10th amendment to kick Federal Law enforcement out of their state.


What does bother me just a bit, however, is that she actually suggested that this lawsuit and her decision require her to determine competing harms that are involved. This case is not about competing harms, but rather a simple manner of following the constitution. But even as she suggested as much, she does not find enough "harm" to be able to justify a restraining order. She got the ruling correct, but in some way, she is still getting the legal logic wrong.


It's hard for anyone involved here to suggest that Minnesota is going to seriously work with Homan, DHS, and this Administration on this subject. Even as they promise and suggest that they are open to compromise, their actions suggest that they will do everything in their power to undermine the entire thing. Walz and Frey are all in on the idea that the DHS needs to pull all resources out of their city and state and leave them and their multi-billion-dollar fraud scam alone. They would much rather have riots and protests and people dying than to actually agree to follow the law and have a safe environment for their citizens.
