The reasoning given is that Merchan and the rest of the Democrats see the business records as little more than an excuse to find him guilty of the real crime. Winning in 2016.
McCarthy goes on to argue that there is no way that this particular crime (as seen in Democratic circles) can possible be rectified with anything other than jail time.
Given that the prosecution started their opening statement and ended their closing with the argument that Donald Trump buried stories to win the election, one has to believe that McCarthy is on to something.
While we will discuss the secondary bookkeeping misdemeanors being elevated to a felony by claiming they were designed to hide another obscure misdemeanor that still required a third crime to make it work... till the end of time, all of that was a ruse to get to the real crime of Donald Trump winning the 2016 election. In the end, we can all pretty much know that this was in the hearts of these highly partisan Democratic voters sitting in the jury box.
Judge Merchan has tossed aside any meaningful pretense of being fair here. What would justify the means if the ends were to end with the dud of Trump being given probation or being fined. If Merchan truly wants to be the hero to the left at the expense of the integrity of the New York legal system, then he has to follow through to the end. According to McCarthy, that means jail time.
I hope he is wrong... but it's a pretty solid argument.
