McCarthy goes through these one by one and I believe he guessed them all. But the bottom line is that in each and everyone of these indictments, Smith is looking to rehash an old court case that tossed the same sorts of cases out.
That being said, nobody actually believes that Smith is actually a serious prosecutor at this point. His job is not to seek to justice, but to make sure he can stop Trump from running for President because of the strong fear from Democrats that he would likely win. There is no excuse to bring unprecedented charges against a former President and Presidential candidate unless it is completely beyond reproach. You should allow no opportunity for any legal experts to question your legal logic or ethical decision making.
All that being said, this is exactly why Biden had Garland bring in Smith from Australia (couldn't find anyone here, huh). Because they knew Smith would show no real regard for anything other than the Democratic cause to bring down a political opponent by any means necessary.
