Latest Biden student loan forgiveness plan runs into legal troubles

Two separate Federal Judges have put a halt to most of the program that is intended to go into place on July 1st.

This one is headed back to the USSC and one has to suspect that the future portions of this entire program will be places on hold until the USSC can issue a ruling. I suspect that a ruling from the USSC will not come until after the election.


The question is whether or not this was the plan all along. Just give Biden and the Democrats another chance to attack the courts as partisan and push for their judicial reform that includes court packing and other manners to undermine the independence and authority of the Judicial branch. Hey, we wanted to forgive these student loans, but those nasty judges and justices will not allow us to! Elect us again so we can give them what's what and get your free money to you asap.


Of course, the nuance here is that the two judges to issue early decisions against the program are both Obama appointees, so it doesn't appear to be a partisan thing. I suspect to the degree that either of these judges allowed any of it to continue, they may end up having those exceptions overturned on appeal as well. Ultimately it will the the USSC that will decide, and I don't believe that their opinions on this matter will have changed much since the last time they told Biden it was unconstitutional.

I think one of the judges said they could "reduce" payment amounts, but that would simply extend the loan rather than forgive any of it.
