Judge Dugan found guilty of felony obstruction!

She faces five years in prison for the felony, but likely will not see any jail time.

Federal prosecutors charged Milwaukee County Circuit Judge Hannah Dugan with obstruction, a felony, and concealing an individual to prevent arrest, a misdemeanor, in April. The jury acquitted her on the concealment count, but she still faces up to five years in prison on the obstruction count.


The jury returned the verdicts after deliberating for six hours. Dugan faces up to five years in prison when she’s sentenced, but no date had been set as of late Thursday evening.


The case inflamed tensions over Trump’s immigration crackdown, with his administration branding Dugan an activist judge and Democrats countering that the administration was trying to make an example of Dugan to blunt judicial opposition to the operation.


So let's start with the concept that there was no jury nullification, which was really what the defense was pushing. They provided almost no defense, other than putting ICE on trial. There were three witnesses that couldn't dispute anything that took place and then a character witness. The entire defense took just 3-4 hours. In the closing argument they accused the prosecution (without evidence) of doctoring the video and audio that basically sunk Dugan.


Now the Dugan legal team is suggesting that because she was acquitted on the concealment, that they can appeal to get both charges tossed. But given how little they provided for a defense and given how obvious the crime was, I don't see what logic they use for such an appeal. Their best chance was someone on the jury to decide that they preferred a political statement over a legal argument. At the end of the day, the public plan to appeal comes with a plea for more money. So it sounds more like another chance for Dugan to raise money for her cause. She may need it as she is likely going to be disbarred and possibly lose her pension.
