Is the Georgia case floundering?


The judge overseeing the Fulton County prosecution of former President Donald Trump and numerous co-defendants has directed District Attorney Fani Willis to respond to allegations that she is in a romantic relationship with one of the lead prosecutors and has violated ethics rules.


Judge Scott McAfee ordered Willis to file a written response by Feb. 2. He said he will hold a hearing on the allegations on Feb. 15.


So far Willis and team has been able to secure some pleas so minor that the attorneys involved were not even required to give up their law license or serve a day in jail. We are talking minor misdemeanors resolved with fines that have nothing to do with any racketeering or felony crimes alleged. Moreover, these defendants took no real responsibility for their actions nor did they implicate anyone else. So instead of building a case with plea deals, it seems like the team is giving away lower players in a manner that does nothing to prove the larger charges.


Now we have allegations that the person leading this team (who is by nature a tax and contract attorney) is a lover of Willis who was given this high paying gig as a matter of cronyism. Moreover, it appears that this prosecutor met with White House attorneys for over 50 hours prior to these charges being brought.


Now arguably Willis's own ethical problems might play a limited part in whether or not the charges should somehow be dropped as a matter of legal principle. But if Willis and her team were ordered off the case, the question becomes whether another prosecutor would be willing to try to make heads or tail of a case that most legal experts believe is untenable. While there might be some political pressure to follow through on this, a new prosecutor would really have to look at whether they believe that charges would stick and whether they are motivated to run the same bad case in order to get the bad orange man.

Interesting. Turley has an article this morning that states almost the same thing I did. Just with a little more legal analysis. He believes there is a real chance that Fani and her lover are removed from the case and that the case might even be moved out of the Fulton County jurisdiction. He points out (as I did) that this does not end the prosecution... but it delays the process and it means another prosecutor would have to decide if they wanted to pursue the case.
