It might be true that Kilmar Garcia was not prevented from being deported to El Salvador after all?

So I heard (and pretty much discounted) the rumors that Garcia was prevented from being deported to Guatemala and not El Salvador. I sort of chalked those up to someone misreading the ruling or possibly even an error in the ruling itself where it might have used Guatemala rather than El Salvador in some portion of the ruling. However, it would seem that much of the Garcia family had moved to Guatemala and that was possibly where the danger was. In fact, the ruling specifically suggests as much in the actual text.


The Respondent’s application for asylum is time-barred without exception. However, he has established past persecution based on a protected ground, and the presumption of a well-founded fear of future persecution. DHS has not shown there are changed circumstances in Guatemala that would result in the Respondent’s life not being threatened, or that internal relocation is possible and reasonable under the circumstances. Therefore, the Respondent’s application for withholding under the Act is granted. Finally, his CAT claim fails because he has not shown that he would suffer torture.”


Now it is still possible that this is a typo or something else. Perhaps he is not allowed to go to either El Salvador or Guatemala. I find it dubious that neither the Administration nor any of the courts (even the USSC) would have missed something this obvious. But it also wouldn't shock me if in the heat of all of this, that nobody really took it upon themselves to fully engulf themselves into the details. That somehow the whole thing explodes without any actual truth to the allegations that he was illegally deported. It also didn't help that an administration official stepped up and suggested (reported as admitted) that they illegally deported him. That official was fired for his trouble.


However, this judge seems to want to see the original paperwork, and apparently the Garcia defense doesn't have it. If they do not actually have any documents that prevent him from being deported to El Salvador, what are we even doing here? I would assume that such paperwork can be found by someone. I would assume that at that point this whole thing could get cleared up. But wouldn't that be up to the Garcia team?


Either way, I think that the Administration would be wise to deport the man somewhere other than El Salvador or Guatemala. You know, just to be safe. Why waste the time, energy, and money holding a trial for him here when you can just permanently bar him from the country. I wonder if Trump can cut a deal with Putin to send some of these people to Siberia!
