Is Colorado trying to be too clever for their own good?

They basically stayed their order and are leaving Trump on the ballot pending USSC view. According to Turley they may be hoping the Supreme Court punts if they do not settle it before their primary (Jan 5th),

The office of Colorado Secretary of State Jena Griswald issued a statement that, since the appeal was filed with the Supreme Court, Trump’s name will remain on the ballot  “unless the U.S. Supreme Court declines to take the case or otherwise affirms the Colorado Supreme Court ruling.” That clause  or provision from the opinion may offer a welcomed escape option for both the Supreme Court and the state.


The timing question could have an interesting impact on the case. It could avoid a review by the Supreme Court by effectively mooting the case if the Supreme Court simply lets the clock run past January 5, 2024. The question is whether the Court would see a need to review the matter if no change would occur to the ballot itself.


Well, there you go. Doesn't sound like the state of Colorado is too convinced that they will prevail on appeal. It sounds more like they are just looking for a way to avoid the USSC stepping in and making them look bad. However, as logical as this all sounds, wouldn't this ruling by the Colorado Supreme Court also prevent Trump from being on the general election ballot as well? Unless the USSC believes that Trump will not be the nominee I would think that they would want to issue some sort of ruling, especially in light of other states looking to go down the same path.


I am still hoping for a 9-0 or 8-1 type of ruling from the USSC that slaps down these silly lawsuits. There is no room for this sort of partisan shenanigans. The left has riled up themselves more than enough over this excessive stance that the Jan 6th protests were a coup to overthrow the Government. Of course they believe a few hundred unarmed people led by a man in a fur vest and horn hat was "this close" to becoming our new Government. How could they not? It's such liberal logic!


Ahem....


To think that you have four state Supreme Court Justices (three of them Ivy league graduates) that fall for this nonsense tells me that we are living in a world of alternate reality. I think it is far past the time for the USSC to act like the adults in the room, for a change.

Think Occam's Razor - Occam's razor is a principle often attributed to. 14th–century friar William of Ockham that says that if you have two competing ideas to explain the same phenomenon, you should prefer the simpler one.
