How can you win?

District Court Judge in the seventh circuit orders a TRO on something the fourth circuit appeals court just stayed.

Now what do you do if you are the Administration. You just won a decision in an appeals court that allowed you to proceed with your governing. Then another district court judges uses the same logic as the first judge to order a new TRO. The other problem was that the stay was supposed to be part of a larger decision from the appeals court that has not yet come.

The order in question involves the cancelation of DEI programs and DEI grants. This is a no-brainer. These DEI initiatives are largely created by executive order from the Biden administration. There should be no issues with a new President overturning an EO with a new one.

The problems with competing judges making competing rulings in various districts is the exact reason that national injunctions are not a reliable or normal function to allow nearly 700 district judges to routinely use. These judges are supposed to be ruling only on the people within their jurisdiction, not nationally. This is also why there is such a thing as standing and why it seems crazy to me that state AGs and liberal NGO have standing to sue all across the country over something they have absolutely no personal function with.
