Wondering how a Judge would let them go forward as the news will be 24-7 coming out of the Senate hearings.
There is a big difference between the legal standards of a court hearing and the political standards of a Senate investigation into something. I would find it difficult to believe that this judge will not take this into consideration when he makes his decision on whether to remove Fani and Nate from the case.
In other words, whether or not McAfee believes they crossed the high legal standards of disqualifying someone, the key appears to be the concept that some of this is determined by the "appearance" of impropriety, bias, or conflict. I would find it almost unfathomable that the vast majority of Georgia citizens do not believe that this is politicized, and that Fani and Nate have been lying their collective asses off. McAfee would need to have his head in the sand at this point not to realize his former boss and lover are on the wrong side of public opinion.
Bottom line is that every witness that has come before the Fulton court will also come before the Senate investigation, and one has to believe that they will not be as friendly of a forum as McAfee's court. Moreover, the Senate will be bringing forward additional witnesses whom McAfee has not allowed in front of his bench, and they have way more resources to investigate.
Case in point was a recent situation where there were allegations that Fani Willis met privately with Kamala Harris (presumably to discuss the case). The defense had found travel expenses and billings for meetings and brought this up. Willis suggested that she never met with Harris personally, rather she was just part of a larger group of people invited to watch Harris speak. This seemed plausible other than the fact that she billed the case for this travel and the billing suggested some sort of meeting.
However, the Senate investigations goes further and confirms that Willis had signed into the White House as a private guest to meet with Harris, rather than just to attend a speech with other guests. Apparently, they have different levels of signatures required depending on what you are doing. This is the sort of information that a longer more detailed investigation by the Georgia Senate will come up with that a short court hearing will miss. Bottom line: Another false statement provided by Fani to the court in response to these allegations. She seems to be making up excuses on the fly, with no consideration for the consequences.
Let's be honest here. There will be a lot of new information coming up on this situation as people come forward and the Senate investigators keep overturning rocks. None of it will work to solidify the prosecutor's stories here. All of it will work to further discredit.
Part of me hopes that McAfee stubbornly refuses to kick them off the case, and as more and more information comes forward, it becomes more and more obvious that Fani Willis is no more than a stooge for the Biden/Harris White House. The heat will continue to blaze higher and the calls for them to step down will become more and more intense (even from the left) and Trump will look like even more of a victim than he already does.
