Democrats to sue Texas over new maps claiming racial gerrymandering.

One problem: four of the five new districts are Hispanic majority.

I hate to break it to the Democratic Party, but there is no constitutional right to have a minority majority district be represented by a Democrat. They simply have to create the districts in a minority majority fashion, not guarantee that one party or the other wins it.


As it stands, Democrats simply do not win enough of the Hispanic vote anymore to guarantee those districts will vote Democrat. This seems to be very confusing for them. For so long, they have counted on these districts (and these laws) to demand more Democratic representation. But that was only because minorities overwhelmingly voted for Democrats. Now that this is no longer the case, especially with Hispanics, maps can be drawn with these minority majority districts that will still vote for Republicans. This is exactly what Texas did.


Now everyone understood when these laws were passed that a minority majority district would likely be won by a minority candidate, and 9 times out of 10 that candidate would be a Democrat. But there was never anything in the actual law that required that the winning candidate be either a minority or a Democrat. As it stands, it will not be difficult to draw these maps in a fashion where Hispanics make up the majority, while the overall makeup will trend Republican. It's probably still the case that almost every minority majority black district will vote Democrat, at least for now... but that is not what the issue is here in Texas.


Lastly, the USSC has taken up the case on whether or not the inclusion of minority majority districts is even constitutional, meaning the very law that the Democrats plan to use against Texas may not be even in play in the years to come. Unfortunately, that decision was punted from this session to the next session or we may not even be having a conversation about this today.


Bottom line: even the most liberal of legal analyst are suggesting this is an uphill battle for the Democrats and that they are likely to lose. But that won't stop the Democratic lawsuit Party from moving forward with it.
