Congress has requested the Biden "alias" emails under the Freedom of Information Act and NARA has refused to comply.
There should be no excuse why the National Archives is not turning this over. Turley suggests that they may be relying on the Presidential Records Act to shield Congress from these records. However, as also pointed out by Turley the PRA has an exception carved out explicitly for Congress, if Congress is performing an investigation or requires the information within the jurisdiction of their duties. This is another reason why many believe Congress should open an "impeachment" investigation. This would more formalize the investigation and allow much more access and even stronger subpoena power. Even if the ultimate goal is not the impeachment "vote" anything to leverage the investigation would be welcome.
Oddly, the National Archives seems to be protecting the records of Joe Biden under the guise of the Presidential Records Act. But they clearly ignored the Presidential Records Act with their actions regarding Trump. The Act provides the incumbent President (and only the incumbent President) with access to his or her records for the first five years after they leave office. The fact that the Archives had demanded physical custody of Trump records and knew enough about the records to "alert" the FBI about possible classified documents suggests that they were not (and had no intentions) of waiting five years before filtering through the Trump records. With Obama, those records sat in a warehouse and they have just (within the past year or so) started doing the archiving.
It is starting to become obvious that the National Archives is another Government agency who treats Republicans and Democrats differently. By differently, I mean they are willing to bend the laws in favor of Democrats and against Republicans. This has become a much bigger (and much more obvious problem) all across our Government. Once again we are being given plain and open reasons to not trust our Government to even follow the basic laws of our country. Not sure how much housecleaning needs to be done in D.C, but it is clear that it is way too much for any one Administration to take on.
