DC Circuit Court of Appeals Tosses Boasberg Contempt Order

The district court used the threat of criminal contempt to coerce the Executive Branch to comply with an order it had no authority to enforce. And it directed that coercion toward the Executive’s exercise of its foreign affairs power. The significance of the district court’s error, coupled with the potential for abuse in future cases, justifies our intervention at this stage of the proceedings. Considering the “totality of the circumstances,” the writ is appropriate. 

Exactly! Once it was ruled that Boasberg did not have jurisdiction or authority to make his rulings, threatening a contempt order is just a roundabout manner to still get his order followed. Obviously, the only way to avoid a contempt order would be to follow that order, which in this case had been deemed invalid by higher courts. This was a guy who was not only wanting to charge the Administration with contempt over his unconstitutional order, but was suggesting he would appoint his own law enforcement to take action if the real law enforcement wouldn't. In other words, he was making up his own laws and threatened to enforce them with his own law enforcement. Not sure who he was going to get to challenge the DOJ on jurisdiction, but he was threatening to find someone.

This was not at all unexpected. I think had there been some concession on his part that he was wrong, and had there been an actual written ruling he could point to that was not followed, perhaps a higher court might see some merit in his argument. After all, the flip side would be people ignoring a court order (without a stay) and betting that they win somewhere down the line. But in this case, the order was a "bench order" which has legal murkiness, and it was presented largely too late to prevent planes already in the air to be turned around. I doubt this particular judge will make that same mistake again and pretty much all of his orders will be written.

But another win for Trump and another loss for liberal insanity.
